Informatie over overstappen

Procedures

Een Tenant Admin verzoekt via support om over te stappen naar een andere aanbieder, over te zetten naar eigen infrastructuur (on-premises), over te zetten met voortzetting van het abonnement, of om wissing van de gegevens, en vermeldt daarbij de benodigde gegevens over de bestemming en of de overeenkomst moet eindigen. De opzegtermijn begint wanneer wij het verzoek ontvangen en eindigt op de door u gekozen datum of, als u geen datum kiest, zo spoedig als redelijkerwijs uitvoerbaar is en in elk geval binnen twee maanden. Het overstappen vindt daarna plaats binnen een overgangsperiode van ten hoogste 30 kalenderdagen; is dat technisch niet haalbaar, dan laten wij u dat binnen 14 werkdagen weten en stellen wij een alternatieve periode van ten hoogste zeven maanden voor, die u één keer kunt verlengen. Daarna heeft u gedurende 30 kalenderdagen gratis toegang uitsluitend voor ophalen, gerekend vanaf het latere van de geslaagde overstap en het einde van de overgangsperiode. Voor klanten die onze Algemene Voorwaarden hebben aanvaard, regelt clausule 15 van die voorwaarden deze stappen.

Methoden

Uw export wordt geleverd als een versleuteld ZIP-archief met export.json (uw gegevens in JSON), uw oorspronkelijk geüploade bestanden en manifest.json (een lijst van de bestanden met hun controlesommen en status).

Beperkingen

U kunt tijdens uw abonnement op elk moment een export aanvragen. Er loopt steeds één export tegelijk, en per dag kunnen ten hoogste vijf exportverzoeken worden gedaan. Onze eigen broncode, modelinstructies en -configuratie, interne modelparameters en systeemlogs worden niet geëxporteerd voor zover openbaarmaking onze bedrijfsgeheimen in gevaar zou brengen; uw gegevens en de daarvan afgeleide resultaten blijven exporteerbaar. Kan een oorspronkelijk bestand niet worden meegeleverd, dan vermeldt het manifest waarom.

Registerinformatie

Het register hieronder vermeldt de datastructuren, onderdelen en velden van de export, gegenereerd uit het exportschema, met de versie van dat schema.

Standaarden

Gegevens worden geleverd als UTF-8-gecodeerde JSON in een ZIP-archief met AES-256-versleuteling.

Open specificaties

De structuur van de export wordt openbaar beschreven in het register op deze pagina, dat wordt gegenereerd uit hetzelfde schema waarmee de export wordt gemaakt.

Rechtsgebied

Locatie: de productie-infrastructuur van OBLIGO bevindt zich in de EU, in de regio Sweden Central van Microsoft Azure. Contractbestanden, geplande databaseback-ups en dagelijkse back-ups van virtuele machines worden gerepliceerd naar Sweden South, en AI-verwerking gebruikt een Microsoft-implementatie die beperkt is tot locaties in de EU. Transactionele e-mails worden verzonden via Resend, een aanbieder in de Verenigde Staten. Aanbieder: de infrastructuur wordt geleverd door Microsoft Ireland Operations Limited, een in Ierland gevestigde vennootschap die deel uitmaakt van het Microsoft-concern, waartoe Microsoft Corporation in de Verenigde Staten behoort. Jurisdictie: de infrastructuur is onderworpen aan het recht van de EU en aan het recht van Zweden, het land waar zij zich bevindt. Omdat tot het concern van de aanbieder een in de Verenigde Staten gevestigde vennootschap behoort, en omdat de productieomgeving ook op afstand wordt beheerd door een contractant in Turkije, kunnen verzoeken op grond van Amerikaans of Turks recht niet worden uitgesloten. Op onze Algemene Voorwaarden is Nederlands recht van toepassing; die keuze bepaalt niet aan welke jurisdictie de infrastructuur is onderworpen.

Maatregelen

Technische maatregelen: verbindingen met de dienst zijn versleuteld; contractbestanden worden door onze applicatie versleuteld voordat ze worden opgeslagen; geplande databaseback-ups zijn versleuteld met een sleutel die wij beheren, en dagelijkse back-ups van virtuele machines met sleutels die door Microsoft worden beheerd; en de inhoud van exportarchieven is met AES-256 versleuteld (de namen van de bestanden erin niet). Contractuele maatregelen: in zijn gegevensbeschermingsvoorwaarden met ons verbindt Microsoft zich ertoe gegevens die het voor ons verwerkt niet aan rechtshandhavingsinstanties te verstrekken tenzij de wet dat vereist; te proberen een dergelijk verzoek naar ons door te verwijzen; als het tot verstrekking wordt gedwongen, ons onverwijld in te lichten en ons een kopie van de vordering te geven, tenzij dat wettelijk verboden is; andere verzoeken van derden af te wijzen tenzij het wettelijk verplicht is daaraan te voldoen; alleen gegevens te verstrekken op grond van wetten die de grondrechten eerbiedigen en noodzakelijk en evenredig zijn; en geen enkele derde directe, indirecte, algemene of onbeperkte toegang te geven tot de gegevens of tot de platformsleutels waarmee die zijn versleuteld. Als Cybersol van een autoriteit buiten de EU een verzoek ontvangt om uw niet-persoonsgebonden gegevens, verlenen wij alleen toegang wanneer artikel 32 van de Europese dataverordening (Data Act) dat toestaat, en verstrekken wij als antwoord alleen de minimale hoeveelheid gegevens die is toegestaan. Wij lichten u in voordat wij aan het verzoek voldoen, behalve wanneer het verzoek rechtshandhavingsdoeleinden dient, en dan alleen zolang het achterhouden van die informatie nodig is om de doeltreffendheid van de rechtshandhavingsactiviteit te waarborgen. Deze maatregelen verkleinen het risico van toegang door overheden in strijd met het recht van de EU of van een lidstaat, maar garanderen niet dat zulke toegang nooit kan plaatsvinden.
